THE HISTORY

Formerly Israel & Sackstein Matsepes

The origin of Matsepes Inc. dates back to World War II to a firm called Kalil & Israel that, through regrouping and joint ventures, evolved into Israel & Sackstein. The firm soon earned a solid reputation throughout the country in the litigation, insolvency and conveyancing spheres, and also established a major practice in the Supreme Court of Appeal, Debt Collections and Estate matters is expanded into a practise with expertise in most spheres of the law as set out here-under.

Israel & Sackstein in Bloemfontein and Matsepe Lekale in the Goldfields began working together in 1997 and eventually joined forces to form the Israel Sackstein Matsepe partnership. Both practices were particularly respected for representing many prominent apartheid-opposing clients during the pre-1994 era. At Matsepes Inc. emphasis is placed on diversity and being proactive. As the first black empowerment company of its kind, Matsepes Inc. embodies equity and strives to remain the legal bastion of integrity, providing at all times a personal and professional service to all clients – corporate and individual.

It has also from this partnership that the PDI method of appointments emanated as it was the brain child of the Directors Leslie Neil Sackstein, Vincent Matsepes and Kobus Senekal who in collaboration with the Bloemfontein Master of the High court, Mr Lester Basson contributed immensely to the system of appointment of PDI insolvency practitioners on the masters panel.

As proof of Matsepes Inc contribution to the social responsibility of the company has made available to the University of the Free State Legal Faculty a bursary for all Law Students who qualify.

RELEVANT EXPERIENCE IN PROVISION OF LEGAL SERVICES TO LOCAL GOVERNMENTS
Tsšiu Vincent Matsepe has, among others, been closely involved with local government, having served in the task teams that worked out the establishment and constitution of SALGA in his capacity as Mayor of the Welkom TLC and former Speaker of Matjhabeng Municipality. In that capacity exposure was had with the following transactions:-

1. The protracted negotiations between the Welkom TLC and Colechurch International Ltd who is London Based on their proposal for a Holistic Delegated Management contract with the TLC of its Water/Sewage system. The MIIU was also involved with advice on the transaction and despite a Trip to London for further negotiations, the municipality was advised against entering into this PPP. This gave T. V. Matsepe the opportunity to investigate the Holistic Delegated Management Contract by Jos Municipality in Nigeria and “Colechurch Ltd”. In the process, the experience was gained on Public-Private Partnership agreements, corporatization, implications of private financing of Municipal debt, Management Contracts, Leases/Concessions, and BOTs. Throughout this, the importance of the Local Government Ownership of the Process as embodied in the contracts was steeply embedded.

2. The research advising and final entering into valid agreements between the Phakisa Major Sports Events & Development Corporation, as a juristic person and Two Wheel Promotions Limited a United Kingdom company, which led to the building of the Phakisa Track in Welkom by the Free State Provincial Government ad Phakisa being granted the right to maintain, manage and operate the track on behalf of government. The financing of the scheme was complicated and served as a valuable experience.

3. The experience gained as a member of the National Small Business Regulatory Review Team established by the department of trade and industry proved to be invaluable on regulation by the government, and those aspects of it that inhibits the growth and development of SMME’s. The task, however, was to study and review government policies, regulations and legislation that impedes negatively on this growth.

4. The firm Matsepe & Lekale Inc. also drafted a standard contract or Memorandum of Agreement for Supply of Water Services & Water for the Purpose of Industrial Use, for the Sedibeng Water Board and these contracts are still in use in some areas.

5. T. V. Matsepe also perused and worked through a contract between the Welkom TLC and a Community based service organization as a water service provider for the Community of Hani Park Welkom in terms of the Water Service Act No. 108/1997.

6. T. V. Matsepe was appointed as part of a team of transaction advisers to the Free State Government Department of Health in respect of The Co-Location of Private Hospitals at Universitas and Pelonomi Hospitals. This was one of the first PPP transactions of its kind finalised, and being part of the team was indeed invaluable experience and exposure.

7. T. V. Matsepe also has extensive experience as a liquidator of Insolvent companies and Judicial Manager which includes managing a company that was on the brink of financial collapse to a healthy financial status. He is on the panel's of the Master of the Supreme Court, Bloemfontein, Kimberley, Grahamstown, Pietermaritzburg, Johannesburg, and Pretoria.

8. Our firm specializes in Insolvencies and in Municipal / Local Government Law, Opinions, Debt Collection, Property Law, Commercial transactions in the High Court. Drafting and Analysing Legislation and Constitutional laws, acting as correspondents in the Supreme Court of Appeal

9. T V Matsepe has tendered successfully for the registration of trusts for farmers in the department of Land Affairs in the Free State and successfully completed the establishment of a CPA in the Northern Cape. Representation of farm/workers occupiers in eviction application’s under Esta is done on a regular basis. Mediation services were granted to a large family trust in the Free State with remarkable success.

Kobus Senekal

Kobus Senekal

He is experienced in Commercial Law Litigation as well as insolvencies. He was also an understudy to Mr Leslie Neil Sackstein who had more than forty (40) years experience in insolvencies. Senekal was his understudy for fourteen (14) years and was also involved in insolvency litigation and major insolvency matters and has handled liquidations involving assets worth multi-millions of Rands. He has a farming background and has done various major agricultural insolvencies and can speak Sotho fluently.

He is on the panels of the Master's Offices in Bloemfontein, Kimberley, Cape Town, Grahamstown, Johannesburg, and Pretoria, and holds various appointments in these different divisions.

He also deals with the insolvency and some of the commercial litigation and is also responsible to conduct the insolvency inquiries, in terms of section 64 and 65 of the insolvency act 24 of 1936, section 152 of act 24 of 1936 and section 415, 417, 418 of the Company Act 61 of 1973.

He also serves on the insolvency committee of the Free State.

Deon Honiball

He specializes in High Court Litigation and heads the collections department. He has done Standard Bank collections for the past fifteen (15) years and various other financial and commercial institutions. He has advised provincial departments on several matters and processed Supreme Court Litigation successfully on behalf of Matjhabeng. He has also advised provincial departments in various matters. He acts for most of the major banks.

Barry Cloete

Barry Cloete

Deals essentially with Commercial Law and Conveyancing, as well as Registration of Trusts & Companies. He deals with highly complicated empowerment Transactions.

He is an examiner for the conveyancing exams and was chairman of the LSSA sub-committee on Liquor Affairs.

He successfully negotiated the sale of a neighbourhood shopping centre of R60 million.

He is a past chairman of the Bloemfontein Attorneys Association.
